Naturalisation: Appeal against denial of Swiss citizenship
Any arbitrary refusal of naturalization violates international law.
Appeals can be lodged against cantonal or communal decisions concerning denial of naturalization. The procedure is governed by the relevant cantonal law on the administration of administrative justice. If the violation of the right to be heard, including the reasons for the decision and the prohibition of discrimination, is contested, the Federal Supreme Court is the final court of appeal.
There are many stories that end differently, with rejection or a long wait for the naturalization application. But they all show: It is not easy for many people to obtain citizenship here. And the reasons for a “no” are often incomprehensible and seem arbitrary.
Naturalization can be refused for various reasons, including insufficient income, criminal offences, lack of pension provision, debts, lack of language skills or receipt of social benefits. Errors on the part of the authorities are also possible.
Time and again we hear that naturalization has been refused arbitrarily or in a discriminatory manner, so it is advisable to have a rejection notice reviewed by a specialist lawyer.
Some absurd examples are:
– Naturalization refused because she started an apprenticeship without a permit.
– She was not naturTlized behaese of an outstanding tax bill of 63 francs for which she had not yet received a reminder.
– Refusal of naturalization for the sole reason that the applicant wears a headscarf.
– Man is not naturalized because he mowed the lawn on public holidays.
– A man living in Switzerland was denied naturalization because he annoys his neighbors.
– British man is not naturalized in Switzerland because he doesn’t know enough about raclette.
– Twice denied naturalization because the animal rights activist made herself unpopular by protesting against circus animals and racehorses.
Any person who has been denied naturalization has the right to appeal to an independent court against the denial of naturalization.
