 Appeal against the annulment of simplified Swiss naturalization

According to Art. 15 of the Universal Declaration of Human Rights of 1948, everyone has the right to a nationality which may not be arbitrarily withdrawn.

Revocation of naturalization and withdrawal of Swiss citizenship. In accordance with Art. 36 of the Federal Act on the Acquisition and Loss of Swiss Citizenship (Citizenship Act, BüG; SR 141.0), naturalization can be declared null and void up to eight years after naturalization.

The declaration of nullity of naturalization can be appealed to the Federal Administrative Court
within thirty days of notification of the decision.

Naturalization – nullity proceedings:
The SEM initiates annulment proceedings if it has sufficient information to suspect that naturalization was granted unlawfully. The annulment of naturalization is a measure taken by the competent authority to combat abuse by an applicant during the procedure for ordinary or simplified naturalization or for reinstatement of citizenship.

The procedure for the annulment of naturalization is always initiated if the SEM is made aware of sufficient grounds for suspicion. It is directed against all naturalized or re-naturalized persons residing in Switzerland or
abroad. The SEM is responsible for all proceedings for the annulment of facilitated naturalization or naturalization in Switzerland or abroad.
