Adult adoption in Switzerland
According to the new law (since 1.1.2018), the adoption of a person of legal age – also known as adoption as a minor – is also possible if the adopting person already has their own offspring, provided the other requirements of Art. 266 of the Swiss Civil Code are met. Adult adoption is the exception and is subject to the following conditions (Art. 266 ZGB). Adults can be adopted if:
they are permanently in need of assistance for physical, mental or psychological reasons and the person wishing to adopt has been caring for them for at least 1 year
the adult person to be adopted has been cared for and brought up by the adoptive parents or persons wishing to adopt for at least 1 year before the age of 18
there are other important reasons and the adult person to be adopted has been living with the adoptive parents or persons wishing to adopt for 1 year
If the child comes of age after the adoption application has been submitted, the provisions on the adoption of minors remain applicable if the requirements were previously met (Art. 268 para. 4 ZGB).
If the adopter (or adoptive parent) dies after submitting the adoption application or if the adopter becomes incapable of judgment after submitting the application, neither death nor incapacity prevents the adoption if the requirements are otherwise met (Art. 268 para. 3 ZGB). With the entry into force of the revised adoption law on January 1, 2018, the revised adoption law will be applied to adoption proceedings pending at the time of entry into force.
