Instead of a B permit, many new arrivals are issued an L permit. The question that many Foreign nationals ask themselves is: Why do I get an L permit while others are issued a B permit?
Issuing, extending and converting the L permit for gainful employment for EU/EFTA nationals
Please note the following with regard to the issue, extension and conversion of the L permit for gainful employment:
EU/EFTA nationals are entitled to an L permit for gainful employment if they can prove that they have been employed in Switzerland for between three months and 364 days. Within this framework, the permit can be issued after registration with the Residents’ Registration Office.
Extension and conversion of L permit
The duration of the permit follows the duration of the employment contract. The L permit for gainful employment for a period of less than 364 days can be extended upon application. The L permit for gainful employment is converted into a B permit if proof of permanent employment or employment for a fixed term of at least 365 days is provided. The agreed minimum workload and the duration of employment must have been bindingly guaranteed in the employment contract.
Applications for an extension of the L permit for gainful employment or its conversion into a B permit must be submitted in writing to the Basel-Stadt Migration Office at least three weeks before the permit expires, together with the following documents:
Written application (letter) for extension of the L permit or conversion to a B permit (no special form is required).
Copy of the employment contract or declaration of employment signed by the employer and employee.
Copy of valid passport or valid identity card.
Note: In many cases, an employment contract that lasts longer than 12 months qualifies towards a B permit, but this only applies on a case-by-case basis.
